Defendant, Randy L. Dugger, appeals (1) from a judgment and sentence following his conviction by jury verdict of the crime of third degree assault by assaulting a deputy sheriff with intent to prevent and resist lawful apprehension and detention (RCW 9A.36.030(1)(a)); and (2) from a judgment and sentence following revocation of probation previously granted upon his plea of guilty to the crime of second degree burglary. He contends the trial court erred (1) in the assault case, by denying (a) his motion for a new trial and (b) his motion to dismiss the charge, and (2) in the burglary case, by revoking his probation solely on the basis of the conviction in the assault case. We find no error and affirm both sentences.
